Terms of Service

1. Acceptance of Terms
By accessing or using Marble ("the Platform"), operated by [Legal Entity Name] ("Marble," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of a school, district, or organization, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to all of these Terms, you may not access or use the Platform. We recommend printing or saving a copy of these Terms for your records.
2. Description of Service
Marble is a school enrollment lottery management platform that provides:
- Cryptographically verifiable random selection for school admission lotteries
- Application submission and tracking for families
- Lottery administration and compliance tools for schools and districts
- Automated notifications for application status, offers, and deadlines
- Complete audit trails for transparency and regulatory compliance
Marble is a technology platform. We do not operate schools, make enrollment decisions, or guarantee admission to any program. Schools and districts retain sole authority over their enrollment policies and final decisions.
3. Accounts and Access
School and District Accounts
School and district accounts are created by authorized administrators. By creating a school account, you represent that you are authorized to act on behalf of that institution and that your use of the Platform complies with all applicable federal, state, and local laws, including FERPA.
- You are responsible for all activity under your institution's account
- You must designate at least one account administrator
- You must promptly revoke access for staff who leave your institution
Family Accounts
Family accounts are used by parents and legal guardians to submit lottery applications on behalf of their children. By creating a family account, you confirm that you are the parent or legal guardian of the children you register, or that you have legal authority to act on their behalf.

Information Accuracy
All users agree to provide accurate, current, and complete information during registration and throughout their use of the Platform. Providing false or misleading information — including but not limited to residency, sibling status, or guardian relationships — may result in disqualification from lotteries and termination of your account.

4. Free Lottery Participation
Marble's core lottery system is free for families. Families will never be charged to enter, participate in, or receive results from any lottery on the Platform.
Schools and districts pay for the Platform through subscription plans. No portion of subscription fees is passed to families, and participation in a lottery is never contingent on any payment by a family.
5. Paid Subscriptions
Subscription Plans
Marble offers tiered subscription plans for schools and districts. Plan details, features, and pricing are described on our Pricing page and may be updated from time to time. Your subscription is governed by the plan you select at the time of purchase.
Billing
Subscriptions are billed annually in advance via [accepted payment methods]. All fees are quoted in U.S. dollars. You are responsible for providing accurate billing information and keeping it current.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel at least 30 days before the renewal date. We will send a renewal reminder at least 45 days before your renewal date. Renewal pricing may differ from your initial rate; any changes will be communicated in the renewal notice.
Refunds
Subscriptions are non-refundable once the billing period has begun, except where required by applicable law. If you cancel mid-cycle, you retain access through the end of your current billing period. Marble may, at its sole discretion, offer prorated refunds or credits on a case-by-case basis.
Adding Schools Mid-Cycle
If you add schools to your subscription during a billing period, the additional fees will be prorated for the remainder of the current period and reflected in your next invoice.
6. Acceptable Use
You agree not to:
- Use the Platform for any purpose other than its intended school enrollment lottery functions
- Submit false, misleading, or duplicate applications
- Attempt to manipulate, reverse-engineer, or interfere with lottery draws or their results
- Use automated tools, bots, scrapers, or scripts to interact with the Platform
- Attempt to gain unauthorized access to other users' accounts or data
- Circumvent or disable any security, authentication, or access-control features
- Use the Platform to violate any applicable law, regulation, or third-party right
- Transmit viruses, malware, or any other harmful code through the Platform
Marble reserves the right to investigate suspected violations and to suspend or terminate accounts that violate these Terms, with or without prior notice.
7. FERPA Compliance
Marble acts as a "school official" with a "legitimate educational interest" under the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g. Specifically:
- Marble performs institutional services that the school would otherwise perform itself
- Marble's use of education records is limited to the purposes for which the data was disclosed
- Marble is under the direct control of the school with respect to the use and maintenance of education records
- Marble does not re-disclose personally identifiable information from education records without authorization
Schools retain ownership and control of all education records. Marble processes student data only as directed by the school and in accordance with our Privacy Policy and any applicable Data Processing Agreement.
8. Data Ownership and Portability
Schools and districts own all data they submit to or generate through the Platform, including student records, application data, and lottery results. Marble claims no ownership rights over your data.
Upon request, Marble will export your data in a standard, machine-readable format (CSV or JSON) at no additional charge. Upon termination of your account, Marble will retain your data for the period specified in our Privacy Policy, after which it will be securely deleted.
9. Lottery Results and Dispute Resolution
Marble uses a seeded Fisher-Yates shuffle algorithm with cryptographic randomness to conduct lottery draws. Each draw produces a verifiable audit trail. Regarding lottery results:
- Draw results are final once published by the administering school or district
- Marble provides the technology and audit trail but does not adjudicate disputes between families and schools
- Any challenges to lottery results must be directed to the administering school or district
- Marble will cooperate with schools to provide audit data in the event of a challenge
- Technical errors attributable to Marble will be addressed promptly, and affected draws may be re-run at the school's direction
Marble is not responsible for enrollment decisions made by schools or districts, whether or not those decisions are informed by lottery results generated through the Platform.
10. Intellectual Property
All content, features, and functionality of the Platform — including but not limited to software, algorithms, design, text, graphics, logos, and documentation — are the exclusive property of Marble or its licensors and are protected by U.S. and international intellectual property laws.
You may not copy, modify, distribute, sell, lease, or create derivative works based on the Platform or any of its content without our prior written permission. "Marble" and the Marble logo are trademarks of [Legal Entity Name]. You may not use our trademarks without our prior written consent.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MARBLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF A LOTTERY SEAT, MISSED DEADLINES, LOSS OF DATA, LOSS OF REVENUE, OR INTERRUPTION OF SERVICE, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.
MARBLE'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MARBLE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF MARBLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
MARBLE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. MARBLE DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM USE OF THE PLATFORM.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM MARBLE OR THROUGH THE PLATFORM SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
13. Indemnification
You agree to indemnify, defend, and hold harmless Marble and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use or misuse of the Platform
- Your violation of these Terms
- Your violation of any applicable law, regulation, or third-party right
- Any content or data you submit to the Platform
- Any dispute between you and a school, district, or other user of the Platform
14. Termination
Termination by You
You may terminate your account at any time by contacting us at support@marbleadmissions.com. For school and district accounts, termination takes effect at the end of your current billing period. Family accounts are terminated immediately upon request.
Termination by Marble
Marble may suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent activity, non-payment, or extended periods of inactivity.
Effect of Termination
Upon termination, your right to access and use the Platform ceases immediately. Marble will handle your data in accordance with our Privacy Policy and any applicable Data Processing Agreement. Sections of these Terms that by their nature should survive termination will continue to apply, including but not limited to: Intellectual Property, Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association in [City, State], except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.
YOU AGREE THAT ANY ARBITRATION OR COURT PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration against Marble.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform with a new "Last Updated" date and, for school and district accounts, by sending an email notification at least 30 days before the changes take effect.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Platform and terminate your account.
17. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and any Data Processing Agreement, constitute the entire agreement between you and Marble regarding your use of the Platform.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- Waiver: Marble's failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or the right to enforce it in the future.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without Marble's prior written consent. Marble may assign its rights and obligations without restriction.
- Force Majeure: Marble shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.
